Knoji Improvement Guarantee Terms and Conditions

These Terms and Conditions govern the Knoji Improvement Guarantee. The complete Terms and Conditions below apply.

1. Promoter and service provider

1.1 The Knoji Improvement Guarantee is offered as part of the tutoring services provided under the Knoji Tuition brand.

1.2 Knoji Tuition is operated by the following legal entities:

Knoji Rouse Hill Pty Ltd
ABN 41 689 646 160

Alpha One & Simply English High School Pty Ltd
ABN 23 660 262 475

1.3 In these Terms, “Knoji”, “we”, “us” and “our” mean the legal entity identified on the Student’s invoice or enrolment confirmation as the provider of the applicable Eligible Course.

1.4 Before an invoice or enrolment confirmation is issued, an enquiry submitted through the Guarantee landing page is received by Knoji on behalf of the entity that will provide the Student’s course.

1.5 Knoji’s primary contact details for the Guarantee are:

Knoji Tuition — Bella Vista
Suite 205, 14–16 Lexington Drive
Bella Vista NSW 2153

Email: bellavista@knoji.com.au
Phone: (02) 9157 6962

1.6 A Parent may also contact the Knoji branch administering the Student’s enrolment.

2. Nature of the Guarantee

2.1 The Knoji Improvement Guarantee gives eligible new Students an additional opportunity to consolidate their learning if they do not meet the applicable Improvement Target after one Offer Term.

2.2 If a Student satisfies all eligibility requirements but does not meet the Improvement Target, Knoji will provide the applicable Holiday Theory Intensive described in these Terms and the Offer Schedule for free.

2.3 The Holiday Theory Intensive will re-teach the applicable term content and help the Student apply that content to the types of questions assessed.

2.4 The Guarantee does not promise that every Student will achieve a particular school mark, assessment result or academic outcome.

2.5 The Guarantee is not a cash-refund or money-back offer.

3. Offer Schedule

3.1 These Terms are designed to operate across different school terms.

3.2 The Offer Schedule identifies the Offer Term, Eligible Courses, Assessment Groups, assessment arrangements and Holiday Theory Intensive sessions applying to a particular promotion.

3.3 The Student is eligible only for the courses and Assessment Groups identified in the applicable Offer Schedule.

3.4 If there is an inconsistency between these Terms and the Offer Schedule, the Offer Schedule applies to the extent necessary to resolve that inconsistency.

4. Definitions

In these Terms:

Assessment Group means the English Assessment Group or Mathematics Assessment Group described in these Terms and the Offer Schedule.

Commencement Week means the week during Week 1 or Week 2 of the Offer Term in which the Student completes their Initial Assessment and, where applicable, free trial class.

Eligible Course means an English or Mathematics course for a Student in Years 6–11 offered by Knoji and identified in the Offer Schedule.

Final Assessment means the applicable course’s end-of-term test used to measure the Student’s result at the end of the Offer Term.

Holiday Theory Intensive means the free five-hour online session described in these Terms.

Improvement Target means the minimum improvement required under section 18.

Initial Assessment means the assessment used to establish the Student’s starting score.

Offer Schedule means the schedule applying to a specific promotion and Offer Term.

Offer Term means the school term identified in the Offer Schedule.

Parent means the Student’s parent or legal guardian.

Program means the particular Knoji subject, course and year-level program in which the Student is enrolled.

Student means the child registered for the Guarantee.

5. Acceptance of these Terms

5.1 The Parent and Student accept these Terms when the Parent submits an enquiry through the Knoji Improvement Guarantee landing-page form.

5.2 A separate signature, contract or Guarantee-specific acceptance checkbox is not required.

5.3 By submitting the enquiry, the Parent confirms that:

  • they are the Student’s parent or legal guardian, or are otherwise authorised to submit the enquiry;
  • the information provided is complete and accurate; and
  • they have read and accepted these Terms and the applicable Offer Schedule.

5.4 Submitting an enquiry does not require the Parent to enrol the Student after an available free trial.

6. Eligible Students

6.1 The Guarantee is available only to a Student who is not currently enrolled in a Knoji course when the Guarantee enquiry is submitted.

6.2 A former Knoji Student who is no longer enrolled qualifies as a new Student for this requirement.

6.3 A Student who has previously completed only a Knoji free trial qualifies as a new Student for the Guarantee.

6.4 Section 6.3 does not entitle the Student to another free trial if they have already used their available free trial for that course under Knoji’s Free Trial Policy.

6.5 A new child from a family with another child already enrolled at Knoji qualifies as a new Student for this requirement.

6.6 A Student who is currently enrolled at Knoji is not eligible, including where the Student proposes to add or change courses.

6.7 A Student who currently attends Alpha One may qualify for the Knoji Improvement Guarantee, provided that:

  • the Student is not currently enrolled at Knoji;
  • the Student is enrolling in an Eligible Knoji Course; and
  • every other requirement in these Terms is satisfied.

6.8 Enrolment at Alpha One does not, by itself, make a Student ineligible for the Knoji Improvement Guarantee.

6.9 A Student who satisfies the new-Student requirement must still satisfy every other requirement in these Terms.

7. Eligible Courses and Assessment Groups

7.1 The Guarantee applies to the following Knoji courses:

  • English courses for Students in Years 6–11; and
  • Mathematics courses for Students in Years 6–11.

7.2 Courses for Year 12 Students are not included in this offer.

7.3 Chemistry, Biology and other Knoji subjects are not included in this offer.

7.4 The two Assessment Groups are:

  • English Assessment Group: Eligible English programs for Years 6–11; and
  • Mathematics Assessment Group: Eligible Mathematics programs for Years 6–11.

7.5 Each individual year-level Program will use assessments relevant to the content taught in that Program.

7.6 Assessment results are determined separately for each Program, even though qualifying Students from different year levels will attend their Holiday Theory Intensives during the same scheduled time window.

8. Enquiry and free trial

8.1 The Parent must submit an enquiry through the designated Knoji Improvement Guarantee landing-page form.

8.2 Knoji will contact the Parent to help identify an appropriate course and, where the Student is eligible under Knoji’s Free Trial Policy, arrange a free trial class.

8.3 Free trials are subject to Knoji’s ordinary Free Trial Policy, including the limitation of one free trial per course.

8.4 Where the Student is eligible for a free trial, the trial must ordinarily occur during the Student’s Commencement Week.

8.5 If the Student has previously used their free trial for the relevant course, Knoji may proceed directly to course placement, the Initial Assessment and enrolment without providing another trial.

8.6 No tuition invoice will be issued merely because the Student submits a Guarantee enquiry or books an eligible free trial.

8.7 A Parent remains free to decide not to enrol the Student after the trial.

9. Activation of the Guarantee

9.1 The Student must complete the Initial Assessment during the Commencement Week.

9.2 If a free trial is available, the free trial and Initial Assessment may be completed in either order during the Commencement Week.

9.3 The Guarantee becomes active only when:

  • the Initial Assessment has been validly completed;
  • the Parent chooses to enrol the Student;
  • the Student is enrolled in an Eligible Course; and
  • all other applicable requirements are satisfied.

9.4 The Student must commence tuition in Week 1 or Week 2 of the Offer Term.

10. Fees and full-term participation

10.1 The Student must enrol in the applicable Eligible Course for the full Offer Term.

10.2 All applicable tuition fees for the Offer Term must be paid in full by the required due dates or under an approved payment arrangement.

10.3 Discounts and other Knoji promotional offers may be used with the Guarantee, subject to the terms applying to those offers.

10.4 The Guarantee does not prevent a Parent from cancelling a course or requesting a refund or credit under Knoji’s ordinary policies.

10.5 However, if the Student withdraws from the course, discontinues before completing the Offer Term or receives a refund or credit that means the full Offer Term has not been paid for, the Guarantee will no longer apply to that course.

10.6 Section 10.5 does not limit any right or remedy available under the Australian Consumer Law.

10.7 These participation requirements are conditions of receiving the Guarantee benefit. They do not create a lock-in contract or remove the Parent’s ability to discontinue the course under Knoji’s policies.

11. Attendance requirement

11.1 The Student must attend at least nine classes during the Offer Term for every Eligible Course relevant to their Guarantee entitlement.

11.2 A replacement class attended online or in person may count if it is arranged or approved by Knoji.

11.3 Receiving class materials, recordings, worked solutions or homework without attending a class does not count as attendance.

11.4 A class missed by the Student does not count towards the nine-class requirement.

11.5 A class for which the Parent receives a refund or credit does not count as an attended class unless the Student also completes an approved replacement class.

11.6 If an operational issue within Knoji’s control prevents the Student from having the opportunity to attend nine classes, Knoji will offer a reasonable replacement class or make an appropriate adjustment to the attendance requirement.

12. Homework

12.1 Knoji strongly recommends that Students complete all assigned homework because regular practice and application are important to academic improvement.

12.2 Homework completion is not an eligibility requirement under the Guarantee.

12.3 Homework will not be manually verified when determining the Student’s entitlement.

13. Initial Assessment

13.1 The Initial Assessment will ordinarily be provided by email and completed at home through the assessment platform nominated by Knoji.

13.2 The nominated platform may include FlexiQuiz or another substantially equivalent assessment platform.

13.3 The Initial Assessment must be completed during the Student’s Commencement Week.

13.4 The Initial Assessment must be completed by the Student named in the Guarantee enquiry.

13.5 Unless Knoji approves a replacement because of a genuine technical or administrative issue, the first valid completed attempt will be used.

13.6 The Initial Assessment establishes the Student’s starting score for the relevant Program.

14. Initial-score eligibility

14.1 The Student’s unrounded Initial Assessment score must be 85.0% or lower to be eligible for the Guarantee in that Program.

14.2 A Student whose unrounded Initial Assessment score is higher than 85.0% is not eligible for the Guarantee in that Program.

14.3 Eligibility is assessed separately for each English or Mathematics Program in which the Student is enrolled.

15. Final Assessment

15.1 The Final Assessment for every Eligible Course is the end-of-term test ordinarily conducted for the Student’s Program.

15.2 The Final Assessment will assess the content and skills taught in that Program during the Offer Term.

15.3 The Final Assessment will ordinarily be completed during the Student’s regular class in Week 9 or Week 10 of the Offer Term.

15.4 If the Student is unable to attend the scheduled end-of-term test, the Student must complete a replacement sitting arranged or approved by Knoji.

15.5 A replacement sitting must be completed by the deadline specified by Knoji.

15.6 Unless Knoji approves another attempt because of a genuine technical or administrative issue, the first valid completed Final Assessment will be used.

15.7 If the Student does not complete either the scheduled end-of-term test or an approved replacement sitting, the Student will not be eligible for the Guarantee in that Program.

16. Comparable assessments

16.1 The Initial Assessment and the Program’s end-of-term test will assess substantially comparable skills and learning areas.

16.2 Questions may use different wording, numbers, examples, texts, source materials or presentation while assessing the same underlying skills.

16.3 The Final Assessment does not have to repeat the exact questions contained in the Initial Assessment.

16.4 For written-response assessments, Knoji may use a consistent marking rubric to compare the Student’s performance.

17. Calculation of results

17.1 Assessment results will be expressed as percentages.

17.2 Improvement is calculated by subtracting the Student’s unrounded Initial Assessment score from their unrounded Final Assessment score.

17.3 Scores may be displayed to one decimal place when communicated to the Parent, but calculations will use the underlying unrounded scores.

17.4 An increase is measured in percentage points, not as a percentage of the Initial Assessment score.

18. Improvement Target

18.1 The required improvement is:

Unrounded Initial Assessment scoreImprovement Target
0.0% to 50.0%, inclusiveAn increase of at least 10.0 percentage points
Above 50.0% and up to 85.0%, inclusiveAn increase of at least 5.0 percentage points
Above 85.0%Not eligible for the Guarantee

18.2 Meeting the exact applicable threshold counts as meeting the Improvement Target.

18.3 If the Student’s improvement is below the applicable Improvement Target, the Student has not met the Improvement Target.

18.4 The Improvement Target is assessed separately for each eligible English or Mathematics Program.

19. Technical issues and exceptional circumstances

19.1 The Parent must notify Knoji as soon as reasonably possible if a genuine technical issue prevents the Student from completing an assessment correctly or by the required deadline.

19.2 Knoji may request reasonable evidence of the issue.

19.3 Where satisfied that a genuine technical or administrative issue occurred, Knoji may approve another attempt or make another reasonable arrangement.

19.4 Knoji will reasonably consider exceptional circumstances affecting the Student’s ability to satisfy a procedural requirement.

19.5 Knoji is not required to waive an academic, attendance or payment requirement unless required by law.

20. Assessment integrity

20.1 Every assessment must represent the Student’s own genuine attempt.

20.2 A Parent or another person must not:

  • tell or encourage the Student to answer questions incorrectly;
  • deliberately cause the Student to leave questions unanswered;
  • complete answers on the Student’s behalf;
  • provide unauthorised assistance; or
  • otherwise manipulate an assessment result.

20.3 Knoji may investigate where it has reasonable grounds to believe an assessment was not a genuine attempt.

20.4 Knoji may ask the Parent or Student for an explanation or require a supervised or replacement assessment where reasonably necessary to verify the result.

20.5 Knoji will not exclude a Student solely because of an unsupported suspicion.

20.6 If Knoji reasonably determines, based on the available evidence, that an assessment was deliberately manipulated or was not the Student’s genuine attempt, the assessment may be treated as invalid and the Student may be ineligible for the Guarantee in that Program.

21. Holiday Theory Intensive

21.1 If an eligible Student satisfies all applicable requirements but does not meet the Improvement Target, Knoji will provide one free Holiday Theory Intensive for the applicable English or Mathematics Assessment Group.

21.2 Each Holiday Theory Intensive is:

  • a five-hour live online class;
  • delivered through Zoom or another nominated videoconferencing platform;
  • conducted in a small-group learning environment;
  • limited to qualifying Students;
  • focused on re-teaching the theoretical content and assessed learning areas from the Offer Term; and
  • designed to help Students apply that theory to the types of questions assessed.

21.3 Students from different year levels will attend during the same five-hour subject window. Knoji may use different tutors, virtual rooms, groups, breakout rooms, materials or activities to provide content relevant to each Student’s Program.

21.4 The session is valued at over $150, based on the value of five hours of comparable Knoji tuition.

21.5 The stated value is a reasonable indication of the educational value and does not represent that the Holiday Theory Intensive is ordinarily sold separately for that price.

22. Entitlement across English and Mathematics

22.1 Eligibility is determined separately for each Program.

22.2 A Student who does not meet the Improvement Target in an eligible Mathematics Program may qualify for the Mathematics Holiday Theory Intensive.

22.3 A Student who does not meet the Improvement Target in an eligible English Program may qualify for the English Holiday Theory Intensive.

22.4 A Student enrolled in more than one Program within the same subject can receive a maximum of one Holiday Theory Intensive for that subject.

22.5 A Student who qualifies in both English and Mathematics may attend both Intensives.

22.6 The maximum entitlement under this offer is:

  • one five-hour Mathematics Holiday Theory Intensive; and
  • one five-hour English Holiday Theory Intensive.

22.7 A Student can therefore receive a maximum of two Holiday Theory Intensives under the Offer Term.

23. Dates and attendance

23.1 The Mathematics Holiday Theory Intensive will be held on Wednesday 6 January 2027 from 10:00am to 3:00pm AEDT.

23.2 The English Holiday Theory Intensive will be held on Thursday 7 January 2027 from 10:00am to 3:00pm AEDT.

23.3 Only one date and time will be offered for each Assessment Group.

23.4 No alternative date, makeup class, credit, refund, cash payment, transfer or substitute benefit will be provided if the Student is unavailable or fails to attend the scheduled session.

23.5 The Parent is responsible for ensuring that the Student is available at the scheduled date and time.

23.6 Knoji will identify eligible Students and contact their Parents with the session details. A separate claim is not ordinarily required.

24. Online access and costs

24.1 The Parent is responsible for providing:

  • a suitable computer or device;
  • a stable internet connection;
  • access to the nominated videoconferencing platform;
  • a suitable learning environment; and
  • ordinary stationery or learning materials specified by Knoji.

24.2 Knoji is not responsible for the Parent’s internet, equipment or other ordinary participation costs.

25. Changes or cancellation by Knoji

25.1 Knoji may make reasonable changes to the delivery platform, tutor, virtual classroom or operational arrangements without reducing the core five-hour educational benefit.

25.2 If Knoji cancels a scheduled Holiday Theory Intensive or makes a material change that prevents the Student from accessing the promised benefit, Knoji will provide a reasonable replacement session or an equivalent educational benefit of no lesser value.

25.3 Knoji will give affected Parents reasonable notice wherever practicable.

26. Reassessment after the Intensive

26.1 After completing the five-hour Holiday Theory Intensive, the Student will be asked to complete a further assessment relevant to their Program.

26.2 The reassessment will occur after the session, using the instructions and completion period provided by Knoji.

26.3 The reassessment is used for educational and progress-tracking purposes.

26.4 The reassessment does not create an entitlement to another Holiday Theory Intensive or another benefit if the Student still does not meet the Improvement Target.

27. No cash redemption or transfer

27.1 The Holiday Theory Intensive cannot be exchanged for cash, a fee refund, account credit or another service.

27.2 The entitlement is personal to the qualifying Student and cannot be transferred to another Student, sibling, family, course or Assessment Group.

27.3 This section does not limit any refund, remedy or other right available under the Australian Consumer Law or Knoji’s ordinary policies.

28. Other offers and Knoji policies

28.1 The Guarantee may be combined with other Knoji discounts and promotional offers.

28.2 Other offers remain subject to their own terms and conditions.

28.3 The Student and Parent must continue to comply with Knoji’s ordinary enrolment, payment, refund, attendance, makeup-class, conduct, assessment, intellectual-property, safety and technology policies.

28.4 If another Knoji policy conflicts with these Terms specifically in relation to the Guarantee, these Terms apply to the extent of that conflict.

28.5 Nothing in the Guarantee restricts a Parent’s ability to discontinue tuition or request an eligible refund under Knoji’s ordinary Refund Policy. Discontinuation may, however, mean that the Guarantee’s separate eligibility requirements are no longer satisfied.

29. Personal information

29.1 Knoji will collect and use personal information to:

  • administer enquiries and enrolments;
  • arrange free trials and course placement;
  • deliver and mark assessments;
  • calculate Student progress;
  • determine eligibility;
  • communicate with Parents;
  • deliver the Holiday Theory Intensive; and
  • comply with legal and operational requirements.

29.2 Knoji may disclose relevant information to tutors, staff and service providers assisting with the Guarantee, including assessment, email, information-technology and videoconferencing providers.

29.3 Personal information will be handled in accordance with Knoji’s Privacy Policy and applicable privacy law.

29.4 Knoji’s Privacy Policy

30. Outcome notification and reviews

30.1 Knoji will ordinarily compare assessment results and identify Students who did not meet the applicable Improvement Target.

30.2 Knoji will contact the Parent of an eligible Student with the relevant Holiday Theory Intensive details.

30.3 If a Parent believes an outcome is incorrect, they may request a review by contacting Knoji and providing:

  • the Parent’s name;
  • the Student’s name;
  • the relevant Program;
  • the reason for requesting the review; and
  • any supporting information reasonably available.

30.4 A review request should be submitted within 30 calendar days after the outcome notification.

30.5 If no notification was received, the Parent should contact Knoji promptly after becoming aware of the issue.

30.6 Knoji may review attendance, payment, enrolment and assessment records and may request further relevant information.

30.7 Knoji will provide the Parent with the outcome of the review within a reasonable period.

30.8 There is no fee to request a review. The Parent is responsible for their ordinary costs of making the request, except for reasonable expenses Knoji agrees to reimburse or is required to pay by law.

31. Australian Consumer Law

31.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

31.2 “Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.”

32. General provisions

32.1 Knoji may update these Terms for future Offer Terms.

32.2 A change will not materially reduce a benefit already activated for a Student in an existing Offer Term unless the change is required by law or the Parent agrees.

32.3 If any provision is invalid or unenforceable, the remaining provisions continue to apply.

32.4 A failure or delay by Knoji in enforcing a provision does not waive that provision.

32.5 These Terms are governed by the laws of New South Wales, Australia.

32.6 The parties submit to the courts and tribunals having jurisdiction in New South Wales, without limiting any right the Parent may have to bring a claim elsewhere under applicable consumer law.
